Your Will is one of the most important documents you will ever sign. It will have a lasting effect on your loved ones and the organisation(s) you wish to benefit. There are several different options you can choose from when you are making a charitable bequest and you should consider them carefully.
A residual bequest is a gift of whatever is left of your estate after all your other gifts, taxes and debts have been fulfilled. This is the type of bequest that is highly recommended as it allows you to decide exactly how much you want to leave to your loved ones, while leaving whatever is left over to HSI.
Typical bequests can include:
a percentage of the total value of your Estate;
a specific cash amount; and/or
a specific gift of say real estate, stocks, shares, bonds etc.
It is important that you seek legal advice when preparing your Will. You solicitor may find the following clause helpful in preparing your Will:
For residual bequests: (the amount remaining after you have taken care of friends and family)
“I give and bequeath to Humane Society International Ltd (ABN 63 510 927 032), in aid of that organisation and for its general purposes, the rest and residue of my Estate, for which the receipt of the Treasurer or other officer shall be sufficient discharge to my Executor for the Bequest.”
For specific cash amounts (or real estate, stocks, shares, bonds etc):
“I give and bequeath the sum of $XXX (or whatever type of bequest you feel appropriate to your situation) to Humane Society International Ltd (ABN 63 510 927 032), in aid of that organisation and for its general purposes, for which the receipt of the Treasurer or other officer shall be sufficient discharge to my Executor for the Bequest.”
